even more intense when yet another four star general found himself in the middle of it all. that general's name is john allen and he is the top commander in afghanistan. the one who replaced the other general who just resigned. it's an awful mess and like any web it's tough to follow. tonight, we will sort it all out. last night, the then cia director david petraeus resigned when word broke that he had had an affair with his biographer paula broadwell that affair surfaced after the fbi started investigating paula broadwell for allegedly sending threatening emails to another woman. that woman's name is jill kelli. she a friend of david petraeus family. a wealthy, married socialite with lots of ties to military bigs in tamp parks home of central command. jill kelley's family is lebanese american. they immigrated from lebanon during the 1970s. during the fbi's broadwell investigation, agents

uncovered 20 to 30,000 pages of documents. mostly emails they tell us between jill kelley and general john allen. is he also married. he is the man who took over for general petraeus as our commander in afghanistan. a senior defense official describes those emails between general allen and jill kelley as flirtatious in nature. the shear volume of emails means they were potentially exchanging an average of 41 pages of emails each day every day for years. while general allen was running our longest war. as for general allen, he has denied he and jill kelley were having an fair at all. adultery is a crime in the military. regardless, this is already having an impact in his career. because the white house has now decided to delay nominating him for a big promotion. >> i can tell you that the president thinks very highly of general allen and his service to his country. as well as the job he has done in afghanistan. at the request of the

secretary of defense, the president has put on hold general allen's nomination as supreme allied commander of europe pending the investigation of general allen's conduct by the department of defense. >> shepard: and if it isn't yet bizarre enough for you. sources tell fbi agent jill kelley sent her a shirtless photo of himself. team fox coverage. catherine herridge in washington. first to jennifer griffin live tonight at the pentagon. jennifer, it feels like there is a puzzle box laid out on a table and half the pieces are missing. >> it brings new meaning to collateral damage, shep. yesterday we thought we were dealing with the fall from grace of one four star jandi one sexual affair. today the woman who started the events jill kelley was found to be in appropriate relationship with the top u.s. commander in afghanistan general john allen. defense officials who are familiar with the hundreds of

emails, 30,000 pages worth say that the general and kelley were having the, quote, email equivalent of phone sex. meanwhile petraeus' biographer paula broadwell has hired a lawyer. her father tells the new york daily news this is about something else entirely. the truth ain't come out. you wait and see, there is a lot more here than meets the eye. >> shepard: the email equivalent of phone sex. that is new here tonight. today we learned both of these generals, petraeus and allen, were involved in a custody dispute directly related to the same woman's family. >> in fact, both generals wrote letters of recommendation for kelley's sister who was involved in that custody dispute. some of them were on letterhead, official letterhead. the petraeus letter said, quote: we hosted them and the kelly li family for christmas dinner this past year petraeus wrote on september 20th of this year. in each case we have seen a very loving relationship.

allen writes i humbly request your reconsideration of the existing mandated custody settlement allen wrote on his official letterhead. kelley and her sister supposedly have acquired a great deal of debt, we have learned, shepard. >> shepard: jennifer griffin live at the pentagon tonight, thanks very much. i mentioned it feels like a puzzle with a lot of pieces missing. we are going to find them. at least according to paula broadwell's father. you see, he has now told the new york daily news newspaper, quote: this is about something else entirely and the truth will come out. he continued: >> you wait and see. there is a lot more here than meets the eye. team fox coverage continues with catherine herridge live in washington tonight. catherine, some question now about when this woman broadwell and jennifer petraeus broke off their affair. >> well, that's right, shep. while a former spokesman for general petraeus has insisted publicly the affair ended four months ago. fox news has learned in the last week of october at a society dinner in washington for the elite of the u.s.

intelligence community, paula broadwell was openly bragging about two book ideas that she and the general were pursuing. the witness who asked to remain anonymous said broadwell was beaming and elated that evening show nothing obvious signs of distress even though the fbi had interviewed her a month earlier about those emails, shep. >> shepard: in an effort to find those missing pieces. one senator is threatening a subpoena to try to get to the bottom of all of this. >> the democratic chair of the senate intelligence committee dianne feinstein is now threatening to subpoena a cia report summarizing the former director's trip to libya the week of october 31st where he personally looked into the consulate attack. as for his failure to notify congress of the fbi's investigation. today the white house saying the buck stops with the bureau. >> i would refer tout fbi. they have, as i understand it, protocols in place for when they notify the legislative executive branches of investigations. and, you know, it is simply a

fact that the white house was not aware of the situation regarding general petraeus until wednesday. >> some lawmakers say they must hear directly from petraeus that he must testify on the hill so that he can explain why three days after the consulate attack he told lawmakers that it was like a flash mob. and why he seemed so wedded to the administration's view that the anti-islam video was to blame. >> at the time he presented the information to congress on september 14th, whether or not he had been told by then or had learned by then that he was under investigation. either consciously or subconsciously that could have altered the information he gave to congress. >> the white house spokesman saying today the acting cia director mike murrow is perfectly capable of stepping in and answering those benghazi-related questions, shep. >> shepard: last night, somebody raided paula broadwell's home. what was that about. >> fbi agents raided the home. they were seen taking evidence bags and computer hard drives from that house. she was first interviewed by the fbi about her relationship

with general petraeus in september. and then again in early november. lawmakers are now questioning the timing of events, especially this unfolding at a lightning pace but only after the election. >> well, i think there is enough room for suspicion here. and a great example is after conducting this investigation for so long, why would the raid on the lady's house just happen this week. if this investigation had been going on for months. i think the fbi has a lot of questions to answer administration officials say the timing is what is it is, shep. >> shepard: it was a nice photo op. catherine herridge in washington tonight. the florida social light joe kelley is a friend to general petraeus. she was the key to his downfall. her own life is very much under a microscope. today cops released recordings of calls she made earlier this week complaining about people on her property. at one point she referred to herself as an honorary council

general and suggest this now diplomatic protection. >> hi, this is jill kelley from 500 bayshore. i have a guy in my backyard and is he not leaving. if you could send somebody out. >> who is this guy if you know? >> i don't know who he is. >> [inaudible] >> i don't know if by any chance because i'm an honor consulate general so i have involumability. i don't know if you want to get diplomatic protection as well. >> shepard: she drives a car with a license plate that says honor consul. does this unpaid social liaison in fact have diplomatic credentials? a state department source tells fox news an honor consu:a made up position people give wealthy people who throw parties and entertain them. as we keep our eyes on military and intelligence leaders, google reports that government surveillance of its citizens is increasing.

especially inside the united states. in its latest bi annual report the company lists demands for information about google users. the united states made more requests than any other nation, nearly 8,000 of them involving more than 16,000 users in just the first half of this year. that number is higher than the next four countries combined. critics say the u.s. ambassador to the united nations susan rice mislead americans on five sunday talk shows after the attack on our consulate in libya. now we are hearing people float her name as a possible replacement for secretary of state hillary clinton. the controversy that's causing next. plus, one of the state's that legalized marijuana just so you can get high now has to figure out how to reconcile new law with that of the federal government which doesn't allow to you use marijuana just to get high. and if they can't work out something, it really could be a serious buzz kill. from the journalists of fox news on a tuesday fox report.

>> bret: as. >> shepard: as we reported before the death the petraeus matter like a oil spill. there is a new questions hot next secretary of state will be. susan rice could be nominated. remember the ambassador is linked to general petraeus in that they each made similar controversial statements in the immediate aftermath of the u.s. consulate attacks in libya. that the attack was not an act of terrorism. as you know, the current secretary of state hillary clinton has said she will step aside after president obama begins his second term. ambassador susan rice has reportedly emerged as the frontrunner for the position. at least that's the trial balloon that white house officials are apparently floating to the news media analysts describe her as a hard nosed diplomat who shares many of president obama's view on foreign policy. as you may recall, after the consulate attack, ambassador rice hit the sunday talk shows and claimed that that assault started as a peaceful protest

over a viral anti-muslim video. she said at the time that militants hijacked the protest and killed four americans, including the u.s. ambassador to libya chris stevens. we now know that story is not true. shannon bream is live in washington with more. shannon, could that initial response keep secretary rice from being nominated to head the state department? >> well, shep, there are some who think that the comments ambassador rice made in the days just after the deadly benghazi attacks will amount to nothing more than a few awkward questions in a senate confirmation hearing should she be nominated. others including republic senator bob corker say it wouldn't be that simple. >> i still have no understanding how anybody who was anywhere near the loop of information could possibly have come out five days later on five different broadcasts and said the things that were said unless they were totally out of the loop. and if they are totally out of the loop on something like, this i think it speaks to a

lot of other things. >> several other republic senators including john and marco rubio have expressed similar concerns about rice. shep? >> shepard: senator john kerry's name has been floated to head the state department and now we're hearing maybe the defense department instead. >> insiders long feel that senator kerry wants. the late pentagon is a bit puzzling for some. decorated war veteran himself. kerry has taken heat for accusing the military for war crimes and stories about tossing away his own medals in protest it. republicans question how that record would go over with the military men and women he would be leading and representing and some democrats are quietly worried that kerry's nomination to head the feds would fed the swift vote opposition. senator kerry's only focus right now is his job as senior senator from massachusetts and chairman of the foreign relations committee. shep, as you mentioned, offensive these names are floated throughout just a trial balloon. >> shepard: shannon bream in washington. the state of washington's new

marijuana law hasn't yet taken effect. people are already getting the benefit of it? prosecutors across the state have started dropping demeanor drug possession charges for adults bust for less than an ounce of pot. election day voters in colorado and washington state voted to legalize recreational use of marijuana. in other words, you can smoke weed just to get high. legally. the law in washington doesn't take effect until next month. prosecutors say they decided to start dropping cases early. of course, one potential problem with the new law is that the federal government still considers marijuana illegal. and washington state's governor met today with the u.s. deputy attorney general to start figuring out how all this is going to work, or not. a millionaire behind a popular software company mcafee software that so many millions of us have is now at the center of investigation after his neighbor turned up dead. and so did his dogs. and now we're hearing stories about him that even mac fee software couldn't keep bottled

up. in fact, have you probably seen this guy every time you sign on. it's next. 

>> shepard: we're learning more about a bizarre case involving a mysterious death. a millionaire who apparently hid in a cardboard box to escape police or that's his story. here is the back story. cops in belize reported this man john mcafee is a person of interest in the shooting death of his neighbor. you recognize that name because he is the founder of mcafee security software which is installed oon more than 100 million computer systems to protect against viruses. police say his neighbor turned up dead on sunday with a gunshot wound to the head. according to wire magazine mcafee then called a reporter and said he had gone into hiding. claiming he was afraid the police would kill him. he reportedly said he hid in

the sand when investigators arrived at his house on sunday and put a cardboard box over his head to breathe. today on "studio b," the reporter who broke the story called mcafee a larger than life character. >> one of mcafee's hobbies is telling tall tales to reporters. >> a hobby. >> it's a hobby of his. he finds enjoyment in his. that's something you need to know about mcafee. listen, i would be surprised if he was actually at any point buried in the sand up to his neck with a cardboard box over his head. that doesn't seem to be a very good strategy for police i would think. >> shepard: mcafee told the "new york times" newspaper his hundred-million-dollar fortune dwindled to just 4 million bucks after the financial crisis. trace gallagher is live in our west coast newsroom. trace, mcafee claims the cops set him up, maybe even killed his dogs. >> yeah, john mcafeces, shep, a few months ago the police in belize raided his home for no reason and confiscated all of his epps with. it turns out that the weapon

used to kill his neighbor a man named 52-year-old gregory fall was actually the same type of weapon that was owned by john mcafee. recently that neighbor complained to authorities that mcafee's four dogs were dangerous. two days before the neighbor was shot to death, the dogs were poisoned to death. legal experts say if john mcafee is being framed, he shouldn't hide. he he should get help. listen. >> you know, you have to look at the person and say do we take what he is saying with a grain of salt. if you were a u.s. citizen living abroad and you were accused of a crime you didn't do, you would want your government to step in and say, wait a minute, he has rights. >> be least police are asking mcafee to come forward and clear his name. if he is is afraid to do so to bring somebody with him. tonight mcafee is still running and contacting a reporter for wired magazine at least 10 different times today including a message that says and i'm quoting here. power was just cut to the house i'm in.

i think this is it. and then a few hours later, he called the very same reporter saying he has changed locations. the police have not caught him yet. and just minutes ago, shep, that reporter says mcafee called him back saying that he had altered his appearance. but we should note that reporter has said that mcafee is involved in drugs, guns, and prostitution. is he paranoid and that he is not to be trusted. >> shepard: trace gallagher in los angeles this afternoon. so, do you have $3,500 lying around there? that's how much more in taxes the analysts say the average american family will pay if congress and the white house drive us off the fiscal cliff at the end of the year. we will hear from both parties. plus, national guard troops now going to new york looking for survivors of super storm sandy who need help. thousands upon thousands of people still in the dark. and now a couple of power companies could end up in court. and they could be the newest weapons in fighting terrorism.

>> shepard: bomb sniffing mice could soap be the latest edition to national security. technicians at a security firm in israel are testing a new scanner that turns rodents into biocensors. workers say they can train the animals to use sharp senses of

smell. load to the side of the scanner. blow air past the test subjects toward the mice. if the mice sense a suspicious odor they supposedly scatter into a corner triggering an alarm. [ laughter ] i know. no word on whether any airports or government security agencies are at all interested. i'm shepard smith. and this is "the fox report." it's the bottom of the hour. time for the top of the news. and we're seven weeks weeks away from going off the fiscal cliff. if we take the plunge on new year's day tax hikes and spending cuts will kick. in economists say we will be headed for another recession. the president set to meet with congressional leaders from both parties on friday to try to work out some sort of deal. today he met with labor leaders, tomorrow he sits down with business executives. the president says he is open to compromise, except when it comes to extending tax cuts for the richest americans. but most republicans say

raising tax rates will hurt the job creators. >> half the congress opposes tax hikes. not because we're selfish, not because we're stubborn, but we know it is the wrong thing to do. we know it will hurt the economy and we know it will destroy jobs. >> shepard: well, the president says the election proved most voters are on his side of this battle. but republicans point out americans also voted to let the g.o.p. keep control of the house. so the districts are well -- anyway, wendell goler is live at the white house tonight. wendell, the two sides are still stuck on the same thing that killed this deal last year. >> groundhog day, shepard. once again, at an impasse over taxes. the president had opened his re-election would give him a mandate for what he calls a balanced approach to dealing with the deficit. republicans are saying just gave him more time to reach a compromise. the white house says reducing the deficit only through spending cuts would mean the poor and the middle class

would pick up the bill. the union leaders that mr. obama met with here at the white house today say that weren't invited to. for a press secretary jay carney says it's only not fair it's not smart. >> the president is clear he will not extend, he will not sign a bill that extends the bush era tax cuts for the wealthiest americans because it's not good policy. >> since both agree on the middle class tax cuts they should be extended and now, shepard. >> shepard: i mentioned those meetings, wendell, today the president i guess preaching to the choir. tomorrow the sinners are in. >> he he will meet with business leaders. i don't know if you want to call them sinners. but certainly more inclined to protect the upper income bush tax cuts than the union people. most small businesses aren't affected by them but the ones that are affected by them create the most jobs. now, senate republic leader mitch mcconnell says raises taxes on those businesses would cost 700,000 jobs. the president says we would simply return to the tax rates of the clinton years in which the economy created almost 8

times as many jobs as the administration of george w. bush. president will make his case to the public tomorrow and civic leaders on friday which is when these talks with congressional leaders come in. >> shepard: wendell goler on the north lawn. seven weeks isn't really seven weeks when you are talking about congress. lawmakers just got back to work today. then they are off next week for thanksgiving. then they will take a break for christmas and then time is up. mike emanuel is on capitol hill. one of the lawmakers back at work today congressman paul ryan. the republic vice presidential nominee. >> that's right, shep. paul ryan is expected to have a lot of clout after the elections. obviously a more recognizable name around the country. and he will continue on as the house budget chairman. ryan did not say a whole lot to reporters today. he seemed to be trying to get back into the swing of things here on capitol hill. but paul ryan does say he thinks he needs to be part of the solution, making this divided government work. >> because the issues we talked about, you know, seven

days ago are still the issues we have to deal with today. the economy, a debt crisis. we have got a healthcare system problem. i'm worried about our military. so, these same problems exist and we're going to have to find a way of finding common ground to make them work. >> that may prove challenging. sources say lawmakers are not expected to get seriously in to trying to solve some of these major problems until after thanksgiving. shep? >> shepard: at the same time we got freshman orientation for new members of congress. what are they up to. >> that's right. a number of new faces walking around here on capitol hill trying to get their bearings, that includes three senators elect on the republic side. they are ted cruz from texas, february fish everywhere from nebraska and jeff from arizona. they met from senate republic leader mitch mcconnell who says they are ready to tackle difficult problems. house democratic leader nancy pelosi welcomed newly elected democrats to the house. they will be figuring out office assignments, learning house rules and ethics and how to set up congressional

offices. the rookies in the house are at a dinner this evening. hosted by the speaker of the house, john boehner. shep? >> shepard: mike emanuel live on capitol hill. just in to fox news from the o really file? the chief operating officer of the long island power authority or lipa is stepping down in the wake of super storm sandy. this comes on the same day an attorney filed a lawsuit against lipa claiming negligence in the aftermath. and the attorney is seeking class action status potentially including hundreds of thousands of long island customers who, in some cases have had no power for two weeks. the feds say only about 25,000 customers in the storm zone are still in the dark only. certainly a major improvement since just yesterday when the number was three times that. but today as the new york city mayor michael bloomberg pointed out that figure does not include tens of thousands of homes and businesses that are destroyed or too badly damaged for crews even to restore electricity. >> the majority of new yorker

who's remain without power do so not because the utilities can't provide power on the street but because necessary repairs still have to be performed. >> shepard: it's not just homes and businesses. the storm badly damaged several hospitals in new york city. now we are hearing two may not be up and running until some time next year. "the fox report's" correspondent jonathan hunt live in the world famous coney island section of brooklyn, new york with more on that. still tough times out there along the board walk, jonathan. >> yeah, still a lot of people in coney island and far beyond, shep, who need a lot of help. and part of the operation of getting them that help being run here in coney island by the national guard. we tagged along with a unit of national guard troops earlier today as they went door to door in the many apartment buildings that are scatter ited across coney island, trying to bring help, whatever anybody needs to those who desperately need it it listen. >> you guys don't have any prescriptions or medicine

issues? >> no. >> you guys are okay with all of that. >> yeah. >> hot water or. >> no no hot water. we don't have that. >> no heat or. >> no hot water. >> you have electricity. >> we have electricity. >> okay. >> no hot water. >> okay. sounds good. thank you. >> so don't leave me alone, man. [ laughter ] >> the national guard troops tell us they really will not leave anyone alone. they have so far checked something like 21,000 residences here in coney island. they are going to keep going until they have knocked on the door, they say, of every single one, shep. >> shepard: national guard troops, jonathan, not the only ones out there helping today. >> no. a lot of volunteers on hand today at a major distribution center that's been set up here. it is being run partly by the city of new york. partly by private companies who are donating all manner of much needed materials.

canned goods, bottled water. gator raid drinks. and, in many cases, a hot meal. a lot of people lining up. we have been here for about 12 hours today, shep. and i would say for about 10 of those hours, until the distribution center closed down, there were hundreds in line. and that distribution center will be back open tomorrow morning, giving the help that these people still, as i say, desperately need and want. shep? >> shepard: i don't know than hunt in the middle of it it all in brooklyn. torrential rains triggered deadly flooding across several cities and that tops our news around the world in 80 seconds. italy. days of heavy downpours causing rivers to burst their banks in the central part of the country. emergency crews report a car plunged off a collapse bridged in tuscan any. rescuers in a helicopter saved the man from the rising waters. hundreds of people have evacuated the region. thailand, customs agent stopped a truck packed with

refusely 600 deadly cobras at a security check point near the capital city of bangkok. they report smugglers were bringing the venomous snakes to other country for food or medicine sun. they have been following the case for a year. they say they will release the surviving snakes into the wild. united kingdom. a former history teacher replicated part of a world war i trench in his backyard in southeast england. the guy says a few dozen volunteers spent an entire month digging the 60-foot long pit. they wore replica uniforms and spent an entire day and night in the trenk to experience the conditions of soldiers on the front lines. china. the annual air show china kicking off in the southern province. the week long event features stunts from a british-based wing walking team. members of the chinese air force also entertained folks with a parachute performance and that's a wrap on this fox
